Os “combatentes inimigos” e a Guerra ao Terror: A relação entre Suprema Corte e política externa nos EUA durante o Governo Bush II (2001-2008).

Resumo

Como se deu a relação entre Suprema Corte e política externa dos EUA após o Onze de Setembro, quando a Guerra ao Terror dominou a agenda da política externa de George W. Bush (2001-2009)? As medidas tomadas pela Administração após o ataque envolveram a elaboração da categoria ‘combatente inimigo’, a articulação entre os conceitos de ação preemptiva e guerra preventiva e a discussão sobre a aplicabilidade ou não das Convenções de Genebra aos presos em questão. Essas questões foram discutidas na Suprema Corte, e ficaram conhecidas como "detainee decisions". Em cada caso, a Corte estabeleceu limites ao Executivo para deter suspeitos de terror, o que exigiu do Governo a elaboração de uma nova estratégia. É este o cenário no qual se propõe a discutir a relação entre Judiciário e política externa nos EUA. Sustenta-se que através de um arcabouço teórico eficiente, ainda que, em alguns momentos, impreciso, elaborado a partir da natureza singular da Guerra ao Terror, o Executivo ampliou significativamente seu poder de ação na arena dos poderes presidenciais de guerra e de política externa. A ampliação desse poder perpetua uma relação de legitimação dos atos executivos que vem se consolidando desde o início do séc. XX.
